How can you change jobs if you have not filed for I485 and it has not been pending for >6months?
If you change jobs you will have to start green card process again.
If you stay with your current company, and if PD becomes current in summer, they can file for 1485 and then once your i485 is pending for >6 months you can try to change jobs using AC21.
Gurus step in and correct me if I am wrong.
All reliance on my opinion is at your own risk.
Good luck.

Put yourself in the USCIS officer's shoes and think how these 2 jobs are similar? The only similarity between both of them is these 2 jobs are in IT. That's it.

Thanks for reply. If I-94 issued for 1 year, suppose we change home address from one state to another state, until what time the driver's license will be issued(most of the states check the I-94 validity end date)? will it be only 1year till the I-94 expires? If yes, what is the process of renewing the driver's license after one year.
Thanks

There are lot of discussions about this issue, and there seem to be mixed opinions so far. it may not be a bad idea to check with your lawyer, and post your findings to the group. AFAIK, it is possible to file multiple I-485 but interim benefits should be tied to only one.

Immigration Visa Attorney Blog Has Just Posted the Following:
http://www.immigrationvisaattorneyblog.com/flag_CNMI.gifAll immigration law attorneys must deal with foreign countries, unique international legal issues, and some quaint interpretations of law. The lawyers at Los Angeles' Fong & Chun are no exception, and in fact, this recent change affects some of our clients who do business in or own businesses in the Commonwealth of the Northern Mariana Islands (CNMI).
On 28 November 2008, "the United States" as defined for purposes of the Immigration & Nationality Act (INA) just got bigger, with the addition of the Commonwealth of the Northern Mariana Islands. Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:
Because the CNMI will become part of the "United States" as defined by 101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. Isn't this esoterica fun? --jcf

I e-Filed the AP for my wife and myself over a month ago. We received the receipt notice for my application but did not receive it for my wife's application. The e-filing generated the receipt number starting with LINxxxxxxxx for both the applications that shows as valid application at the USCIS's online status tracker. Should I contact the USCIS's customer service and inquire about the receipt notice for my wife's application of just ignore it coz' its not a big deal as we already have the receipt numbers?

I'm not from India but I believe in Karma. We create our own future through our actions. If we perform a good action today we can expect a good result. That is why it is so important that the undecided people attend the rally!
Think of retrogression as Sansara. A vicious circle. It is only by acting and creating our own Karma that we will get out of Maya and see reality. Our gren cards will not fall from the sky, we have to go get them! By not going to Washington and assuming that your green card will suddenly appear out of nowhere, you are proving to yourself that you are stuck in some sort of immigration avidya.
We need to act with selflessness as in Karma Yoga, so that we can understand how our unity will bring the results we seek, to all of us.
Remember Arjuna when he realizes before the battle that his enemies are his own family. We at IV should not be our own enemies by not attending the rally, because we all know what Krishna told Arjuna: "Your duty is to fight"
Instead of hurting each other, we need to use karma and our friendship for each other to unite in our common cause and fight. Remember, our duty is to fight, it is our choice then to fight against each other (by not attending the rally and letting others do it) or fight all together, united against retrogression, and create the good Karma that will ultimately defeat the broken immigration system.
We all are family! Let's fight together friends!!! Come JOIN US IN DC!!!!

What is my status from Jun 14th to June 25th ? Am I in status because I have a I94 valid till June 24th or will I be out of status for those 10 days ?
Can I work and have my payroll run for hose 10 days (June 15th to June 24th).....
Many times I-94 is issued for I-797 end date + 10 calendar days. These 10 additional days are given person can wrap up things, but he/she is not allowed to work for these 10 days. That's reason for I-94 date of June 24th, even though I-797 authorization ends on June 14th.
Your attorney should have asked for extension starting with June 15th, since old I-797 work authorization expires on June 14th, 2010.
Now, you are in status, but can not work from June 15th until June 24th. That could be leave without any pay.

Hi, I'm trying to take 2 kids from my daycare to see their dad before he gets deported. The mom cant do it because she has a restraining order against him. Is it possible to visit someone once they get picked up by immigration from jail? If so how and what do I need to do to make this happen? I'm trying to do this for the kids, they don't understand what is going on and they feel responsible, they are the ones that called 911. Mom has no problem with me doing this she just wants the kids to see that their father is OK.
Here is some info that might be useful:
he is scheduled to be released for deportation on 12/03/10
he is in Santa Clara County Department of Correction Elmwood Facility
Any help would be appreciated.

The local San Diego USCIS office suggests that certain remedies may be available for military families facing the problem of ineligibility to adjust status because of unlawful entry by a family member seeking adjustment of status. Most often the situation occurs when a United States citizen service members spouse entered without inspection and thus cannot adjust status. Current way to fix the status is via Ciudad Juarez waiver process (I-601 waiver application (http://www.visalawyerblog.com/2008/07/san_diego_immigration_attorney_4.html)).
One potential remedy is Parole in Place, where the District Director in San Diego, Mr. Paul Pierre, can parole the alien, who then will be eligible to adjust status. Paroling only cures the issue of admission or parole under INA 245, not other inadmissibility issues. To seek Parole in Place, address the request to Mr. Pierre. Include the following:
1. Form I-131 (but it does not need to be paid for when applying)
2. Evidence of impending deployment
3. Proof of relationship of alien to the United States citizen service member
4. Evidence of hardship to the service member and how the situation affects the service members readiness to perform his or her mission in defense of the United States.
USCIS also has a program where I-601's will be adjudicated at the United States Consulate in Ciudad Juarez at the time of an immigrant visa interview for the relatives of service members. Mr. Pierre also has the authority to grant Deferred Action. (Regarding issues of admission for adjustment of status purposes, read Sum v. Holder, 602 F.3d 1092 (9th Cir. 2010).) The Conrad 30 J1 waiver program has been extended to September 09.
I believe IV core has been actively pursuing the Conrad 30 Improvement act. Can core please update us regarding the chances of this legislation passing in September 09 ?
Yes that is correct. IV core member Paskal has been leading this initiative from the front. He will provide an update. If you are part of the IV Physicians group, you may find more information from him.
