My lawyer checked my application type as
"h", and stating "Spouse has an approved I-140"
Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."
Does it hurt to choose "h"? Thanks!!
If you are a dependent, you should probably choose (b). I chose (b) for my dependent wife, which is what my attorney recommended. Don't know about (h), but why complicate matters?

I am having a proiblem with the I140 approval and I485 visa requested in wrong category. My Labor Certification is filed in EB3( BS with 2 plus years of experience). The company does not want to take risk hence filed in EB3 category.
After the labor certification is approved I filed my I140 in EB2 with the appropriate documentation qualifying for the upgraded/change position with additional skills and my I140 got approved in EB2 and the approval has 203 (b) 2.
After filing I485, interview is scheduled and the officer satisfied that the documents are sufficient and I am approveable the Immigration Officer requested visa number and came back saying no visa number is available hence we need to wait. At the time of interview(Ocotber 2005) both EB3 and EB2 are retrogressed. The officer did not give any sort of documents hence did not know anything such what category he requested what code did he use.
In July 27th the Immigration Officer mentioned that the previous officer requested the visa number in EB3(E37). I spoke with an attorney who said that it is possible to change and hence taken the steps to correct the error/mistake of wrong EB Category.Because of this wrong category I did not get visa number.
What are my chances that the USCIS goes back and corrects the error and put back in EB2 and request number in E21 or E26.I already sent the letters of my I140 approval, receipt of I140. What process should I take apart from reaching out CIS Ombudsman, Congresswoman,Senator,self letter addressing to the USCIS about the error and the potential long waiting periods for no fault of mine.
Any suggestions?

first of all i am sorry to hear that your company is not doing good..oh well we are in a recession so who isnt?
anyways, your 485 was filed last month, kind of sucks, bcos you can invoke AC21 if your 140 is approved (in your case it is), 485 >180 days, find a similar job with more or exact pay mentioned in your LCA..Use your EAD and lose your H1 status ( could be risky if your AOS is denied, then you do not have a status).
In other case, you need to find a company which can sponsor (transfer your H1) and then start your perm all over again.
Other senior posters, pls shed some light on this topic. Is AC21 safe ? what is the probabilty of getting GC through AC21 without an RFE?

This if u sent your packet by US postal mail . Fedex and other courier dont deliver to PO boxes . There is another street address for other courier.

I am wondering if the P.O Box address is right and should i wait for 90 days or call them based on Lockbox receipting update bec as per Aug10th release TSC shows done receipting till June 28th? Is there a way to inquire regarding my application?

There's no set time for getting a greencard. It depends on which EB category you're in and the visa bulletin's priority dates.

Sorry you cannot claim. You have been a resident of GA, so rent/meals/commutation/laundry cannot be claimed as deductions in Tax return. You never had a home in NY/NJ. You will surely be a RED flag for IRS. Dont do wrong things to get some money. State the truth and be satisfied of the tax return you get.
However, you can surely ask your employer to give a part of your salary as expense reimbursement, which is legal.
Trust me, you get more tax return here in US, than in India.

If you don't get your Cards in a reasonable timeframe, I suggest you take an appointment with your local USCIS office using infopass, and take a copy of this ruling to show them. I expect them to act promptly after seeing that you are considering suing them for the delay.

Unfortunately, the only solution is to take your camera to a Nikon repair center. It seems that the D2H's meter failing is alarmingly common, from what reports one reads online. If your camera is yet under warranty, then you're in luck. Otherwise, it may be a US$200 - $300 repair. :(
