Now working on H1b, 8th year
PD: Oct 2005
I 140: approved
I 485: pending
AP, EAD: approved
I want to change job to another employer.Can the new employer file an H1b for me based on my approved I 140. I prefer to be on H1b as traveling is easier and don't have to wait for the EAD, AP each year and the uncertainities invloved.
I would appreciate replies.

But he does not apply for the K-3 visa...I have to file the petition. So he still has to be in India? Could we re-marry in Canada? Then I file here?

US rolls out new online visa form in India

NEW DELHI - With the demand for US visas surging by the day, the US embassy and its consulates in India have introduced a new online non-immigrant visa (NIV) application form to cut out needless delays.
The DS-160 form will be online on the website of the US embassy from Jan 19. For all NIV visa appointments starting Feb 1, applicants will need to fill out the DS-160 form, the US embassy said here Wednesday while announcing the introduction of the new form.
The new form, that leverages new technologies, is expected to cut processing delays as applications could be pre-processed and pre-screened before an applicants interview.
Applicants will continue to complete visa application forms online, as they did previously with the Electronic Visa Application Form, the embassy said.
The demand for American visas has been escalating in India over the years.
The four US consulates in the country had processed 725,000 visas in 2007 - a 58 percent increase from 2006.
India is among the top 10 countries sending visitors to the US.

My company has applied for my H1 extension 3 months in advance of the current expiring H1 under regular processing
1. Does the 240 day rule apply AFTER the expiry of the current H1 OR 240 days from the date you apply for the H extension. I hope its not the latter coz I could have told my employer to apply closer to the expiry instead of 3 months in advance.

You can get a licence valid upto 6 moinths from the date of H1 receipt notice. You can go to Wayne Rt 23 MVC. I got it myself last year from there.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

I just got an RFE for I-485...they are asking about marriage certificate and birth certificate...when I applied for I-485, I sent marriage certificate and birth certificate ..why they are asking me again to send?
And can you tell me please what to do with the following.......Uscis sent me too an envelope where to put my documents for RFE.......but the docs dont fit in the small envelope...is it ok if I put my docs in a different and bigger envelope?
My PD is sept 2005 ROW.
If someone faced the same situation please help me with some advice.

Walk-ins are highly unlikely, if not impossible at any location. Emergency visa appointments are still available, I think. Check the individual consulate for the procedure. However, you need to have a genuine and verifiable reason for an emergency appointment. For regular visitor visas, you must get an appointment scheduled in advance, simply no way around it.

Myself(Husband) & mywife both came on H1B from same employer.
My son got H4 visa through my wife H1B visa.
I (Husband) applied for green card and got EAD for myself & mywife , got Advance parole for myself, mywife & myson and are in 485 pending AOS status,
My Wife is taking permanent job with EAD (EAD is through my Greencard process)
If employer cancels my wife H1B she will come to EAD status.
I am not sure what will be the status of my son who is currently on H4 visa through my wife H1B visa.
My son got Advance Parole and 485 pending status through my green card.
Do I need to apply for H4 visa for my son or will my son be ok on pending AOS status ?
His status is AOS. Unless a decision is made on your GC he needs no other visa or documentation to be in USA. If your GC application gets denied (Should not happen ever) then you lose AOS and you will have to talk to an attorney to see how long you can be in US - for the sake of filing an MTR etc.
Once a person files for 485 and application is pending a decision they can be in US without a VISA. If you travel outta US and needs re-entry that could be done useing AP. Hope this helps........

Just couple of days ago immigration-law.com reported about IV and its efforts to bring relief to high skilled community and 2 days later the site gets hacked. I wonder if anti-immigrants have anything to do with it ...... they may be really scared to IV :D

Hello All,
I have a certain queries regarding the transfer from L2 to H1B.
My husband is on L1 and me on L2 with my EAD still under processing. However my husband's firm wants to get his visa converted to H1 which automatically cancels my L2 status and I would have to apply for H4.
So now my query is for how long will his status of L1 be valid will it be till the start date of H1B, or the minute he files in his papers for H1B or when his H1B gets approved?

I was supposed to get my degree in 2000(Electronic Engineering) however due to backlogs and since I started job before degree completion I completed my degree in 2005.
Is that a real big problem?
Although I have double bachelors one in Electrical Engineering and other is science but my work evaluation is based on my bachelor of engineering degree.
