I think you should be fine. Apart from this scenario on the other extreme you could start working for the new company with just the receipt number as well. You dont need to wait for the approval to start working for the new company.

I was wondering If I can start H1B visa transfer to the new company via premium processing(hopefully will get approved in 2-3 weeks) and continue to work for the current employer and get paid till the end of May, even the though the transfer would have been approved in the end of April.

So it looks like I have 2 independent questions:
1. Can an H1B be transferred to a new company once the H1B holder is in their 6+ year?
2. Can one port their EB3 case to EB2 with a new employer?
After reading around in forums, the answer for question 2 seems to be Yes and with some successful examples.
What is still not clear is questions one.
Any help please?

Hi Guys,
Just some few questions. Me and my wife are in separate H1 visas. I got my 140 and 485 applied thro my compnay and my wife has gotten her EAD and AP. She is thinking of switching jobs now with her EAD. I understand that her H1 status expires if she does that.
Here is my predicament. I know it's far fetched. but wanted to throw it out to get some opinions.
say my wife quits her current job and takes up another position with her EAD and then 6 months down the road i dont get my 140 approved and i'm fired. Here are the list of questions i have
1) the EAD expires october so we have to file the ead around june to get it renewed, will it be valid for the time period it is specified even though i dont have my original job? (i'm planning to apply for my EAD now). i'm hoping i dont get fired by then..
2) Can we invoke AC21 in this situation? will it work?
3) is it too risky to change now or wait till the 140 approved?
4) can the compnay revoke the 140 after 180 days whether it is approved or not? i'm prety positive that they wont..but u never know...

Yes but I was thinking, spouse and children are counted in family based visas and how exempting them will benefit EB visas. Correct me if I'm wrong. :confused:

Indian Bro/sister need to wait 10 years to file I-485.

Send a detailed letter explaining that you are at a risk of losing job to the EAD expedite fax line.
Another alternative is to take infopass and explain the situation to them and take the letter with you so that can send it to the proper place.

My priority date is in Oct 2005 (ROW) and yesterday was the 180th day after filing my I-485 application. I need some help in deciding if I should wait for the green card with my current employer or think of changing the job using AC21. Your suggestions will be really helpful.

Samething happened to me. On 11/25/2007 i saw a LUD on my approved I-140 (which was approved in Dec, 2006). And then LUD on 12/06/2007 and 12/07/2007 on I-485 for both self and spouse.
Not sure what it could be?? I filed I-485/EAD/AP in late July, 2007. Have received EAD and have done finger printing. Have not received AP yet. Filing Center in Nebraska. My PD is October, 2005, EB3 ROW.

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?

I am currently working for big consulting firm, they hold my H1 and 485 is pending for more than 6 months. i have valid EAD from pending 485.
I am getting full time opportunity, my new employer is ready to transfer H1 as well as they are willing to accept me using EAD. so its entirely my preference.
can you please tell me adv/dis adv of using H1 over EAD or vice versa. (my 6 yrs of H1 will finish in another 6-7 months)
